This website is operated by Feltie Kits Inc. (“Feltie Kits,” “we,” “us,” or “our”), an Alberta, Canada corporation. Throughout the site, the terms “you” and “user” refer to the customer, browser, or visitor of our website. Feltie Kits offers this website, including all information, tools, and services available from this site to you, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site, including without limitation users who are browsers, customers, merchants, wholesalers, and/or contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services. We also use third-party providers, including Klaviyo, to manage email communications and marketing. Your use of our website is also governed by our Privacy Policy and Return Policy, which are incorporated into these Terms by reference.

SECTION 1 - ELIGIBILITY & ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence, or that you are at least 13 years old and have obtained your parent or legal guardian’s consent to use this site. Individuals under 13 are not permitted to use this website or our services. If you are under 18, you may use the site only under the supervision of a parent or guardian.

You understand that your content (excluding credit card information) may be transferred unencrypted across various networks. Credit card information is always encrypted.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the service without our express written permission. You may not scrape, crawl, mine, or index the site using automated tools without prior written consent.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We do not warrant that information on the site is accurate, complete, or current. Product descriptions, pricing, and availability may contain errors or omissions. We reserve the right to correct such errors without notice. Any reliance on the material on this site is at your own risk.

SECTION 4 – PRODUCTS, SERVICES AND DIGITAL CONTENT

Certain products or services may be available exclusively online. These items may have limited quantities and are subject to return or exchange only as permitted under our Return Policy. We make every effort to display product colors and images accurately; however, we cannot guarantee your device’s display will be accurate.

All Feltie Kits, printable instructions, digital tutorial videos, and character designs are for personal, non-commercial use only. You may not reproduce, resell, repost, share, upload, stream, distribute, or commercially use any video tutorials, printable instructions, digital downloads, or Feltie Kits characters or designs without our explicit written consent. Unauthorized reproduction, distribution, or publication of our designs or digital materials is strictly prohibited.

No Guarantee of Crafting Results

We provide step-by-step guides and tutorials, but we do not guarantee that your finished Feltie will look identical to our examples. Results vary based on individual crafting skill.

SECTION 5 - SHIPPING, DELIVERY & DELAYS

Once an order leaves our facility, delivery is handled by the carrier (e.g., Canada Post, UPS, DHL). We are not responsible for: 

  • Carrier delays
  • Lost, stolen, or damaged packages
  • Incorrect shipping information provided by the customer.

Any claims must be filed directly with the carrier unless otherwise required by law.

SECTION 6 - WHOLESALE TERMS 

Wholesale purchasing is permitted only with prior approval from Feltie Kits Inc. By placing a wholesale order, you agree that:

  • Products are not to be resold online without written authorization.
  • Minimum advertised pricing (MAP) rules may apply, where specified.
  • Wholesale orders may have different return, refund, and restocking rules.
  • We reserve the right to decline or cancel wholesale orders at our discretion.

SECTION 7 - THIRD-PARTY TOOLS & APPS 

We may provide access to third-party tools and integrations, including Shopify apps and Klaviyo. You acknowledge that:

  • We provide access “as is” without warranties.
  • We are not responsible for third-party actions, content, or policies.
  • Your use of third-party tools is entirely at your own risk.
  • Third-party services are governed by their own terms and privacy policies.

SECTION 8 - USER COMMENTS, REVIEWS & SUBMISSIONS

If you submit reviews, photos, comments, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, edit, reproduce, publish, display, or remove your content at our discretion. We may remove content that is unlawful, offensive, defamatory, misleading, or violates these Terms. You agree that any comments you provide do not infringe the rights of any third party.

SECTION 9 - ERRORS, INACCURACIES & OMISSIONS

Information on the site may occasionally contain errors, such as pricing inaccuracies, stock availability, shipping estimates, and product descriptions. We reserve the right to correct them at any time without prior notice.

  • Any claim arising from use of the site, products, tutorials, videos, or digital content
  • Our maximum liability shall not exceed the amount you paid for the product or service giving rise to the claim.

You agree to indemnify and hold harmless Feltie Kits Inc. from any claims, damages, losses, liabilities, or expenses arising out of your breach of these Terms, your misuse of the service, or your violation of any law or third-party rights.

SECTION 14 – DIGITAL CONTENT AVAILABILITY / BUSINESS SALE OR CLOSURE

We strive to maintain long-term access to digital tutorials and printable instructions; however: If Feltie Kits Inc. is sold, transferred, or ceases operations, we do not guarantee continued access to any digital tutorials, downloads, videos, or online materials. You acknowledge that digital access is provided as a convenience and may be modified or discontinued at any time. Continued access to digital materials is not guaranteed and may be removed, modified, or discontinued at any time without refund or compensation.

SECTION 15 - GOVERNING LAW

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta, Canada, unless applicable law requires otherwise.

Both parties agree to attempt good-faith resolution before initiating legal action.

We may update or modify these Terms at any time by posting changes on this page. Your continued use of the website constitutes acceptance of those changes.
